Terms of Service

These terms are the agreement between you and Voicebooks ("we", "us") for the website at getvoicebooks.com and the Voicebooks apps for iOS and Android (together, the "Service"). By creating an account or using the Service you accept them. How we handle your information is set out separately in our Privacy Policy.

Who may use Voicebooks

You must be at least 18 years old, or the age of majority where you live, to hold a Voicebooks account. Children use the Service through a listener profile that an adult account holder creates and controls; they do not hold accounts of their own. You are responsible for what happens under your account, including what the people you invite into your family do with it, so keep your password and your family PIN to yourself.

Your recordings and the material you upload

Your recordings are yours. You keep all rights in the audio you record and in anything else you upload. You grant us only the licence we need to run the Service for you: to store your material, process it (for instance to build the pages of a book from the images you supply), and play it back to the members of your family. That licence lasts as long as you keep the material on the Service and ends when you delete it.

You are responsible for having the right to upload what you upload. Recording yourself reading a book aloud for your own family, inside the app, is a private family use; publishing that recording elsewhere, or distributing copies of a book's pages outside your family, is not something these terms permit or that we can authorise on a publisher's behalf.

The catalog

Books in the Voicebooks catalog, and the images and text within them, belong to their publishers and authors. They are made available for use inside the Service and for nothing else. You may not download, copy, redistribute, or resell them.

Acceptable use

You agree not to:

• Upload material you have no right to upload, or that infringes anyone's rights.
• Upload material that is unlawful, or that is abusive, hateful, or harmful to a child.
• Use the Service to harass anyone, or to contact a family that has not invited you.
• Break, probe, or overload the Service, or try to reach parts of it or accounts that are not yours.
• Scrape, resell, or redistribute any part of the Service or the catalog.
• Share your account with people outside your family in order to avoid paying for it.

Plans, payment, and cancellation

Voicebooks offers a free tier and paid subscriptions. Prices, and what each plan includes, are on the pricing page. Subscriptions bought in the app are billed by Apple or Google under their terms, renew automatically, and are cancelled through your Apple or Google account — not by us. Gift purchases on the website are billed by Stripe.

The Archive Promise. Cancelling a paid plan does not delete anything. A plan limits how many new books your family can add; every book your family has already recorded keeps playing, and you can export your recordings.

Refunds for in-app purchases are handled by Apple or Google under their policies. For anything bought directly from us, write to us and we will deal with it fairly.

We may change our prices. If a change affects a plan you are already on, we will tell you before it takes effect and you may cancel rather than accept it.

Ending the agreement

You may stop using the Service at any time, and ask us to delete your account whenever you like — the steps are on Delete your Voicebooks account. We may suspend or close an account that breaks these terms, that is being used to harm someone, or where the law requires it — ordinarily with notice and a chance to put it right, and immediately where the harm is serious. If we close your account for a reason other than a breach by you, we will give you a reasonable opportunity to export your recordings.

The Service is provided as it is

We work hard to keep Voicebooks running and your recordings safe, but the Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows. We do not promise that it will be uninterrupted or free of errors. Keep your own copy of any recording that matters to you — the export feature is there for exactly that.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. Some jurisdictions do not allow these limits, in which case they apply to you only as far as the law allows, and nothing here limits liability that cannot be limited by law.

Changes to these terms

We may update these terms. We will update the date at the top of this page, and for a material change we will tell you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-laws rules, and the courts located there have jurisdiction — except where the law of the place you live gives you the right to bring a claim closer to home, which these terms do not take away.
